These Terms & Conditions ("Terms") govern your use of the CallSorted service ("Service") operated by Ben Slater trading as Wonderfire, ABN 72 918 637 629 ("we", "us", "our").
By subscribing to or using CallSorted, you ("you", "your", "Subscriber") agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Service Description
CallSorted provides an AI-powered missed call answering service designed for Australian trade businesses. When you miss a phone call, our AI assistant answers on your behalf, gathers the caller's details and job requirements, and delivers that lead information to you via SMS and email.
The Service includes:
- AI-powered call answering for missed calls
- Caller information capture (name, phone, job details, location)
- Lead delivery via SMS and email notifications
- A dedicated Australian phone number (provisioned via Twilio)
- Online dashboard for managing leads (plan-dependent)
- Daily and/or weekly performance digest emails (plan-dependent)
2. Eligibility
The Service is available to Australian businesses and sole traders with a valid Australian mobile phone number. You must be at least 18 years of age and authorised to enter into these Terms on behalf of your business.
3. Account & Registration
To use the Service, you must create an account by providing accurate and complete information including your name, email address, business name, trade type, and phone number. You are responsible for maintaining the accuracy of your account information and the security of your account credentials.
4. Subscription & Billing
4.1 Plans
CallSorted offers multiple subscription tiers (Starter, Pro, Business) with varying features and call limits. Plan details, pricing, and included features are displayed on our website at the time of purchase.
4.2 Billing Cycle
Subscriptions are billed monthly in advance in Australian Dollars (AUD). Your billing cycle begins on the date of your first payment and renews automatically each month on the same date.
4.3 Payment
All payments are processed securely by Stripe. We do not store your credit card details. By subscribing, you authorise Stripe to charge your nominated payment method on each billing date.
4.4 Call Limits
Each plan includes a specified number of AI-handled calls per billing cycle. When your call limit is reached, incoming missed calls will still be answered but in a basic mode that captures only the caller's name and phone number. You will receive SMS alerts as you approach and reach your limit.
4.5 Promotional Codes
We may offer promotional discount codes from time to time. Promo codes are subject to their stated terms, cannot be combined with other offers, and may be withdrawn at any time.
4.6 Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods. Upon cancellation, your dedicated phone number will be released and the Service will cease at the end of the paid period.
4.7 Upgrades & Downgrades
You may upgrade or downgrade your plan at any time. Upgrades take effect immediately with a pro-rated charge. Downgrades take effect at the start of your next billing cycle.
5. Phone Numbers
As part of the Service, we provision a dedicated Australian phone number for your account via our telephony provider, Twilio. This number remains the property of CallSorted and is licensed to you for the duration of your active subscription. Upon cancellation or termination, the number will be released and may be reassigned.
You may use call forwarding from your existing business number to your CallSorted number, or provide the CallSorted number directly to your customers. Both methods are supported.
6. AI Disclaimer
Important: The CallSorted AI assistant is an artificial intelligence system. While designed to be helpful and accurate, it may occasionally misunderstand callers, capture incorrect information, or make errors. You are solely responsible for verifying all lead information before acting on it. CallSorted does not guarantee the accuracy or completeness of any information captured by the AI.
The AI assistant does not provide quotes, make commitments, or enter into agreements on your behalf. It is designed solely to capture caller information and job details.
7. Call Recording & Transcription
All calls handled by the CallSorted AI are recorded and transcribed to provide you with accurate lead information and to improve service quality. By using the Service, you consent to this recording and transcription.
Callers are informed at the beginning of each call that they are speaking with an AI assistant. Call recordings are retained for 90 days and then automatically deleted. Transcripts and lead summaries are retained for the duration of your account plus 90 days after cancellation.
You are responsible for complying with any additional call recording notification requirements that may apply in your state or territory.
8. Acceptable Use
You agree not to use the Service:
- For any unlawful purpose or in violation of any applicable laws
- To engage in spam, harassment, or unsolicited communications
- To misrepresent the nature of the AI assistant to callers
- To capture information for purposes other than legitimate business lead generation
- In a way that could damage, disable, or impair the Service
- To attempt to gain unauthorised access to any part of the Service
9. Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data and the data of your callers. By using the Service, you agree to the data practices described in our Privacy Policy.
10. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control (including but not limited to telephony network outages, third-party service disruptions, or force majeure events).
We will make reasonable efforts to notify you of planned maintenance in advance.
11. Intellectual Property
All content, software, designs, and technology that make up the CallSorted Service are owned by us or our licensors. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the Service for your business purposes during the subscription period.
12. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability to you for any claims arising from or related to the Service is limited to the total fees you have paid to us in the three (3) months immediately preceding the claim.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, business opportunities, or data.
- We are not liable for any loss arising from missed calls, inaccurate information captured by the AI, or any action you take or fail to take based on information provided by the Service.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.
13. Indemnity
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any third-party rights.
14. Termination
We may suspend or terminate your access to the Service immediately if you breach these Terms, fail to pay fees when due, or engage in conduct that we reasonably believe is harmful to other users or to us.
Upon termination, your data will be retained for 90 days to allow you to request an export, after which it will be permanently deleted.
15. Changes to These Terms
We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice via email to the address associated with your account. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.
16. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.
